The Independent National Electoral Commission, or INEC, cannot be dictated to by the judiciary, according to Monday Ubani, chairman of the Nigeria Bar Association Electoral Committee.
In an interview with Arise Television’s “Day Break,” Ubani stated that INEC is unquestionably independent under the Nigerian constitution.
His statement came after the Federal High Court’s Justice Peter Lifu ordered INEC to deregister the African Democratic Congress, ADC, and four other political parties.
On Tuesday, however, the Court of Appeal in Abuja issued an order to halt the implementation of the ruling that ordered INEC to deregister the ADC and four other political parties.
“Justice Lifu on Monday ordered INEC in its judgement to deregister those political parties,” Ubani responded.

After using the administrative action authorised by the constitution, INEC filed a counteraffidavit and concluded that those parties were not in violation.
“However, the court was prepared to replace the body with the authority to do so with its own opinion.”
